High Court of Sindh allows Pharmacy Council to continue Secretary recruitment process

We are delighted to share that our Firm while representing Pharmacy Council and its members got the Petition, filed against our Client, dismissed and its meeting decision uphold. In a Petition filed by the Pharmacy Council's Secretary against our Client challenging (i) termination of his contract on the premise that the majority of council members in the council meeting ordered his termination on grounds of maladministration, and (ii) the subsequent advertisement of the post of Secretary, the Court was pleased to dismiss the petition, allowing our Client to continue with the hiring process. The Honourable High Court of Sindh appreciated our arguments and held that the long or satisfactory service alone does not grant a right to reinstatement of contractual service once expired or terminated, nor can High Courts revive such expired/terminated contracts or alter the terms of contract. Moreover, the Court also held that contractual appointments end with contract expiration/termination, and a temporary/contract employee cannot claim permanent status as a matter of right, nor can he /she be reinstated merely for continuing service beyond his/her term after reaching superannuation age.
