Drug Court acquits Pharmaceutical Company in sub-standard drugs case
Cepal and Co. is pleased to share that it successfully represented its clients against the complaint filed by the Drug Regulatory Authority of Pakistan under the Drugs Act 1976. Our clients, a pharmaceutical company, its directors and production manager were accused of manufacturing spurious, adulterated and sub-standard drug. The central government analyst reported against the accused and the solutions seized. We assisted the Honorable Drugs Court and the analyst admitted in the cross examination that the finished product of the alleged drug was of standard quality. The Court appreciated our arguments that the solutions in the laboratory and unfinished product cannot be justified to draw adverse inference as the production was suspended at the time of raid and the authority violated Section 19 of the Drugs Act as no sample was given to the accused to adduce evidence through an independent laboratory.
